Fat Man Sues McDonald's Over Non-Hire

BRIDGEPORT, Conn. - A federal judge has refused to dismiss a lawsuit against McDonald's, filed by a New Haven man who claims he was not hired because he is overweight.

Joseph Connor had filed the lawsuit last year against the fast food chain, claiming that it discriminated against him, in violation of the Americans with Disabilities Act and the Connecticut Fair Employment Practices Act.

Connor, who weighs 420 pounds, claims that McDonald's violated the laws when it regarded him as morbidly obese and refused to hire him based on that perception.

Further, he alleges that his obesity is a disability, and the restaurant chain violated the CFEPA by deliberately not hiring him.

U.S. District Judge Stefan R. Underhill concluded that Connor must be given the opportunity to prove that he is protected under the law.

McDonald's had argued that obesity, except in special cases where the obesity is due to a physiological disorder, is not a "physical impairment" within the meaning of the ADA.

"The judge' decision is a very important one," Attorney Gary Phelan, who is representing Connor, said Wednesday. "This is the first time a Connecticut court is saying that obesity may be a disability under state discrimination law."

Attorney Lawrence Peikes, who is representing McDonald's Corp., said the judges decision was not on the merits of the case.

"It in no way indicates how the judge views the case factually," Peikes said. "McDonald's is confident there is no merit to the claims and looks forward to having the matter resolved."

I dunno I used to work at McDonalds, and it gets fuckin hot there. Not to mention that there is a lack of moving space. Hot + narrow spaces = not good for fat people.

He'd smell bad, move slowly thru traffic at busy times, and would be very unpleasant for everyone.

Fat people are ok, but 420 lbs is a little too much.

Slim down.

Go work at subway.

I read the headline in the main forum and thought it was another "fat person sues McDonalds for making him or her fat." But this is new.

McDonalds could use what BeTheReds said about the dangers associated narrow, confined areas as defense (hot oil! hot oil!!!) and state that they refused to hire the guy on the account that he may injure himself in the workplace and as a result launch a whole new bunch of lawsuits (i.e. negligence perhaps because McDonalds' didn't take into account there might be large employees walking around places with hot oil. :blink: )

So I support the Golden Arches on this one. And why does this guy want to work at McDonalds' anyway? Rhetorical question, please don't respond. :D

But obesity is a medical condition and people are genetically predisposed... and at 420lbs I don't think the man could use a treadmill...

...just something to think about. It may not be entirely his fault that he's that fat...

The principle of making a business is to make profits and not to be politically correct. Hiring this guy wouldn't be good for business because;

- most likely the work space is small and he's too big
- he probably can't move that fast to take care of the fries, burguers, serving coke, and then cleaning up tables.
- customers might be grossed out to see a sweaty fat guy serving their food
- someone who doesn't weigh over 400 lbs might do twice the job in much less time.

So if you were the owner of tha Mc Donald's would you hire that guy just to be pc or would you rather hire someone who weighs 150 lbs and can work faster? It might not be entirely his fault that he's that fat but if he can't work well and fast and if there's other applicants who can be a lot more competent, then there's no wrong by chosing to hire someone else.

Yeah and you can't go to that Mickey D's and expect customers to like it if you're out of fries or something.....they'll think the fat guy ate it.

As a matter of fact, the guy may be setting himself up for cracks and insults from angry customers (or maybe even just any customer that happens to be an asshole). So maybe this isn't such a good idea. And no matter what happens with this lawsuit, McD's still ain't gonna hire him. It's a lose-lose situation dude.
