Thanks for sharing this article. It reminds me of the film "A Time to Kill" only the situations a bit different. I think Governor Davis is not being sensitive to Ly. It's understandable that killing anyone, even one's worst enemy, is not the way to resolve the issue, but because Ly's doing everything he's suppose to do (e.g. good behavior, counseling, anything....) and has no past criminal history, he should be allowed to go on parole.

He has diagnosed schizophrenia. Why was he incarcerated in the first place? And he's 70 years old. Been in prison for 15 years, hell I don't even think Bernard Goetz did 15 years in prison. Oh wait, Goetz was white, forgot about that minor detail.

why didn't duress play a role in sentencing?

anyhow, davis has *explicitly* said that he will not grant parole to murderers. this is not an official policy but he has made it quite clear. last year, he reversed 51 of the 52 grants of parole for inmates convicted of murder. later, he was sued by an inmate named rosencrantz, because it is *unlawful* to reverse grants of parole solely because of a murder conviction. governor davis stood his ground...and lost the case! you would think that the *governor* would be familiar with the law.

two cases which have convinced me that governor davis is an insensitive moron.

1) my client. suffered through *daily beatings*by an alcoholic husband for over eleven years, during which time, she made numerous attempts to flee. she was an illegal immigrant, sought help from a battered women's home, but was denied because of her illegal status. she fled back to her homeland with her three kids, her husband tracked her down, her catholic father made her return to the states with him. he had a mistress, flaunted their relationship in front of her. the beatings of both her and her children consisted of whippings, punches, mostly. during the last few years, he began pulling out a gun. the gun was fired on several occasions. this was the environment that led my client to commit her crime--to save the lives of her and her children. the board of prison terms *specifically* concluded that she suffered from battered women's syndrome when she committed her crime. she served over fourteen years in prison now--no write-ups, perfect record, earned her g.e.d., became a battered women's counselor, and feels remorse for her crime. the board was touched by her case and granted parole. i called her daughter that very day to inform her that her mother, after 14 years, could finally taste freedom again....and then what happens. governor davis' office messes up the freaking hearing tape. because he could not review and approve it, a rehearing was ordered.

2) my friend's client. fifteen-year old girl arrived from mexico. on the second day of her arrival, woman on the street asked if she would like a job as a housekeeper. she gratefully accepted. job commenced the following week. lady drove her to strange suburb (later found to be alhambra). dropped her off at older couple's home. she cleaned for entire day, and asked to be driven back to the city. man asked her to stay for two more days to clean. she stayed the whole week. he sexually assaulted her. later on, his wife died, and it was just the old man and her in the house. she was forced to remain there for *two years*, along with another mexican couple that he kidnapped and kept in the shed of his backyard. she couldn't leave b/c he convinced her that he was a witch-doctor and would hurt her family. he gave the other couple hallucinogens (without her knowing) and told her that he could make them act crazy whenever he wanted. she thus believed him. finally, the other couple conspired to kill the old man and she agreed. the couple planned the murder and carried it out--she was just an observer. they later both pointed the finger at her. she served over 10 years in prison. finally, the couple recanted their story b/c they could not live with the guilt. so here we have a young girl, kidnapped for two years, raped and terrorized, and then forced to serve for a murder she did not commit. the board granted parole. governor davis reversed.

please please please do NOT vote for davis.

how old were her kids and what happened to them when she was sent to prison?

Well, I don't think there's anything wrong with parole, but I certainly understand if Governor Davis doesn't want to approve parole for Chris Ly. I mean killing someone for vandalizing property--gee, this isn't SINGAPORE, this is AMERICA.

Also, in our sometimes hyper-race-conscious society, if a WHITE man killed a BLACK man over vandalism, we wouldn't hear the END of it...how the white man's a racist and bla bla bla. In this case, race doesn't even enter into considerations. Who's to say the dude didn't think "freakin white people get away with everything. i'm gonna put this cracker punk in his place!"

My feelings about the concept of parole in general are mixed but if Chu Ly, a "model" prisoner doesn't qualify for parole, then what the heck is the entire parole system for? Hell, even the prosecutor lobbied for his early release! So long as our criminal justice system permits parole, Gov. Davis's blanket denial of parole to anyone convicted of murder, I think, is just wrong.

yeh, i'm with arex. i still need to do some research on this, but i've heard that governor davis receives generous donations from the prison guard unions--who have an incentive to keep a larger prison population....hafta do more research on this to speak on it though.

davis is all about the money.

Those whites just want to scare off any more Asians with the heart to fight racism by killing their predators. Governor Davis and his predecessor Pete Wilson should be taken cared of by some crazy Asian guy. Whatever happened to those southeast Asian guys who killed a white guy with knives in defending themselves? Anyone know?

Just cuz the guy was a punk doesn't justify killing him. He shoulda just beat the crap out of him and stopped there. Unless it was like.. self-defense.... he was bound to get busted for that shit.
