I'm not sure if this is a sports matter or a legal matter but you may have heard that SF Giants Barry Bonds 73rd home run ball went into the bleachers and into a group of eagerly awaiting fans. A mr. Alex Popov tipped the ball but couldn't hold it as a mad rush began to seize the ball. It rolled along the floor and as the fans were all over each other a mr. Patrick Hayashi stood up with the ball in his possession. Now he is being sued by mr. Popov for the ball back which is supposedly worth a cool million bucks. So who should get the ball?

Should have made this one into a poll. My vote goes for Hayashi-san. Popov never had the ball in his controlled possession.

When I saw it on the local news here in San Fran, mr. Popov's attorney came up with two (questionable?) witnesses; one claimed mr Hayashi bit her son in the leg to wrest control of the ball form him (which mr Hayashi says is ludicrous). The other witness claims she saw mr Popov grab the ball first and was tackled by the mob. She called mr Hayashi " a little burrower".

Isn't it pretty common to be having people scrambling for a home run (or even foul) baseball in the major leagues ? I don't see anywhere in any bylaws when you purchase a ticket that says you are legally entitled to any ball that's hit in the stand that you touch first. In stadiums like Wrigley Field, they frequently have people outside of the stadium fighting for balls.

Yes, this is true and whoever is the last man standing wins.
However, in this case, on local TV news, it showed a nervous almost quivering mr Hayashi and his attorney while in complete contrast, in walks in mr Popov all cocky and confident with his tall, young blonde on his arm. You shoulda been there, camera bulbs were poppin like crazy!

What they don't want is a "mob rules" where people can beat someone else up for the ball because they think it will set a precedent that anyone can just pile on and whoever gets the ball gets the ball. I did not see a beating but I saw a heck of a dash for the ball.
I think Mr. Hayashi should get the ball because he ended up with it and becase Mr. Popov is making some bogus claims with the biting. Who in the world has time to BITE someone while dashing for a ball? Not only that but Mr. Hayashi was willing to split any earning from the sale of the ball. Mr. Popov wants the ball to be in his sole possession.

Good point. The judge may rule that since Popov had first touch and that he was 'jumped' by the 'mob', the message may be to let people alone when they have first dibs at the ball. I don't think the decision will be a slam dunk.

I've never seen or heard of anyone attempting to take the ball after someone already has it. Ive been to my fair share of ball games and the general rule is if you catch it cleanly it's yours. If it bobbles out of your hand and someone else gets it, tough luck. If it bounces off of you and lands on the ground, it's fair game.
Speaking of which, one time my friends and I went to an Orioles game (vs the mariners) and the first pitch of the game, Ichiro hits a foul ball right at us. I struggled to put on my glove in time and my friend barehanded it. It bounced offa him and onto the ground and he picked it up since there was no one around him. Then I got my glove on. Dammit.
The O's won tho so I was happy.

It didn't matter anyway because we both promised to give it to this girl we went with because we never thought it was going to happen. So be careful what you say.
