Proof before or after the fact valdifies any statement made concerning the prescribed action which has either taken place or the action to be taken.

If an argument does not truly exist, why has there been a response?

The use of "argument" is used equivocally. Three propositions exist of which only two are deemed as arguments. The argument for the first statement is that this claim is not an argument. It is merely a fallacy. The first claim:

Conclusion: "Your hands are cold to the touch."
Argument: whether or not this claim is valid.
My argument: To say such a claim without any observation is a strawman fallacy.

The second claim: "The proposition has been made."
My argument: The proposition you made is not that my hands are cold to the touch. The proposition is:

Argument 1. Proof after the fact validifies any statement made concerning the prescribed action has taken place.
In the case concerning how my hands are cold to the touch ( a prescribed action), argument 1 would not be the case because no fact has been established because nothing has taken place.

Argument 2. Proof before the fact validifies any statement made concerning the prescribed action which is to be taken.
This argument is an ex post facto fallacy.

The statement or claim you proposed is, "Your hands are cold to the touch." No proof supports this statement. Therefore, it doesn't validify the prescribed action. Finally, Nothing is to be taken because an informed consent was never established.

And to answer your question, "if the argument doesnt' really exist, why the response?"

The argument I'm responding to are the two I mentioned above... not the one you attempt to pose as a fact but is really a fallacy.
