Oregon county issues same-sex marriage licenses


PORTLAND, Oregon (CNN) --Multnomah County, Oregon's most populous county, started granting marriage licenses to gay and lesbian couples Wednesday after the county attorney said refusing to do so is unconstitutional.

"The Oregon Constitution prohibits the county from discriminating against same-sex couples when they are applying for marriage licenses because that kind of discrimination based on gender and based on sexual orientation is not allowed in Oregon," said Multnomah County Attorney Agnes Sowle at a news conference in Portland, the county seat.

Immediately afterward, the county began handing out licenses to waiting couples, many of them clutching bouquets, some with children in tow.

One woman, holding up her license, said she had been waiting 16 years for the day. She said she and her partner planned to marry immediately.

Some couples had lined up in the wee hours of the morning outside the marriage office in Portland. Many sang the lyrics from "Chapel of Love" as they waited.

They came after Diane Linn, chairwoman of the Multnomah County Board of Commissioners, ordered the county Tuesday to begin issuing marriage licenses to same-sex couples.

It's unclear how state officials will respond. Attorney General Hardy Myers has been meeting with Gov. Ted Kulongoski and will soon announce the state's "marching plans," said Myers spokesman Kevin Neely.

Neely described Oregon's marriage law as "ambiguous."

The law reads: "Marriage is a civil contract entered into in person by males at least 17 years of age and females at least 17 years of age, who are otherwise capable."

Very cool. I heard, on the news this morning, that a mayor in Upstate NY also performed some same-sex marriages and that criminal charges are being filed against him.

<Sigh> I'm just annoyed that it took Gavin Newsome to start this...

Why didn't it start in San Jose (Santa Clara County)? And what's the prospects of doing so?

Newsome was in a unique position in that his most glaring lack of support was from the far left of SF. With same-sex marriages, he alienated the conservatives, but they'll come around and now he's built a bridge to the left, whom he never would have reached without a bold move like this. I'll also give him the benefit of the doubt with regard to him actually feeling strongly about the issue.

But I imagine that someone like Barbara Boxer does too. She has a record of being almost ultra-liberal, but her office is a state-wide one and so she's playing the safe route of endorsing same-sex civil unions but not supporting same-sex marriages.

There's not too many cities with the political dynamics of SF -- maybe no other. San Jose is a lot more conservative and it just wouldn't fly down here in the same way. And Gonzales is not a stick-his-neck-out sort of a guy. The surrounding communities of the South Bay are even more conservative.

If it would happen elsewhere in the Bay Area, I'd expect it to come from on the Peninsula -- I think I heard that the San Mateo City Council just voted to condemn (or something like that) Bush's proposal of a Constitutional Amendment limiting marriage to heterosexual couples.

Yeah, it's made for some rather uppity protesters. At first it was one or two of the freako religious types but I think this has galvanized the entire state. Rather than living with tolerance I get the feeling we're all taking sides, entrenching ourselves for a fight ahead. Like I read in one article today, you can't uncork the genie.

Exactly I love my mayor and all, but I don't agreed on what he has done. But it should have been done the right way in my opinion.

Sorry, I don't know if this deserved its own topic. Anyway, I keep reading about the complete marriage rights same-sex couples do not get. Most often cited are hospital visitation, health insurance, and things like that. I see rights numbering in the *thousands* cited everywhere. But I can't find a list of all these rights and the laws that deal with them, just summaries of the top issues like this: http://www.massequality.org/hot_the_truth.php Does someone know of a place I can read about them with references?
