Microsoft Takes on Teen Over Web Site

VANCOUVER, British Columbia - Mike Rowe thinks it's funny that his catchy name for a Web site design company sounds a lot like Microsoft.









The software giant, however, is not amused.


"Since my name is Mike Rowe, I thought it would be funny to add 'soft' to the end of it," said Rowe, a 17-year-old computer geek and Grade 12 student in Victoria, British Columbia.


Microsoft Corp. and its attorneys have demanded that he give up his domain name, the Vancouver Province newspaper reported Sunday.


Rowe registered the name in August. In November, he received a letter from Microsoft's Canadian lawyers, Smart & Biggar, informing him he was committing copyright infringement.


He was advised to transfer the name to the Redmond, Wash.-based corporation.


"I didn't think they would get all their high-priced lawyers to come after me," Rowe said.


He wrote back asking to be compensated for giving up his name. Microsoft's lawyers offered him $10 in U.S. funds. Then he asked for $10,000.


On Thursday, he received a 25-page letter accusing him of trying to force Microsoft into giving him a large settlement.


"I never even thought of getting anything out of them," he said, adding that he only asked for the $10,000 because he was "sort of mad at them for only offering 10 bucks."


He said family and friends are backing him and a lawyer has offered to advise him for free.


He's also keeping his sense of humor.


"It's not their name. It's my name. I just think it's kind of funny that they'd go after a 17-year-old," Rowe said.


Company spokesman Jim Desler said Sunday, "Microsoft has been in communication with Mr. Rowe in a good faith effort to reach a mutually agreeable resolution. And we remain hopeful we can resolve this issue to everyone's satisfaction."



Bill Gates needs to have his ass beaten for even attempting to sue this kid.

this is the dumbest lawsuit. okay, so maybe it's infringement or whatever, but it just makes microsoft look *bad*...

just because bill gates sits around collecting his check doesn't mean he's telling his legal dept. to get the kid. legal dept's act on their own when it comes to copyright infringement, or i was under the belief that they did =\

I'm taking a Copyright and Trademark class this semester. The professor warned that once we started taking it, we'd be an annoyance to our family and friends because we'd start viewing everything we see in day to day life differently (which has already happened to me regarding tort, property, and crim issues I see on TV). Its happening already. I'll avoid being an annoyance here though.

He may not be doing it directly, but he has to be in the know about it somewhere, and it's his call to either move ahead with it or to just drop it.

hehe, i know it SOUNDS like microsoft but simply putting one's name and then soft should not be so bad right? i mean only if u look at it like intentionally playing on the sound can u say he was ripping it off like "oh i work for mikerowesoft i can sell u good stuff" that sorta thing. as for the 1337 version of micros0ft yeah that would definetely be blatant squatting

We actually talked about this very case in class this morning. Glad I read this thread before class so I knew about the case!

He didn't tell us what was legal or not though. We're only in our second week :)

yeah i heard, assuming he spent less on the website than it costs to buy said items then he's smart BUT could have been smarter. i would have held out for an XBOX, XBOX live, free games, free MS products (the ones that are worth having at least) and a chance to smear honey on Gates' hand when i shake it
